Will of Henry Hayes Tizard - 1835

Dated 19 May 1835

This is the last Will and Testament of me Henry Hayes Tizard of Weymouth and Melcombe Regis in the County of Dorset Gentleman being old and infirm but of sound Mind Memory and Understanding thanks be to God for the same made and published this nineteenth day of May in the year of our Lord one thousand eight hundred and thirty five.
First it is my Will that all my just Debts Funeral Charges and Expenses be justly and truly paid by my Executors hereinafter named and subject thereto. I give devise and bequeath unto my Sons William Henry Tizard and Henry Hayes Tizard and my Son in Law William Legg their Heirs Executors and Administrators All and singular my Freehold Messuages or Dwelling Houses Lands or Tenements which I shall die seized or possessed of or entitled unto in Possession Remainder or Contingency with their and every of their Rights Members and Appurtenances and all my Leasehold Premises and all other my Personal Estate Money Household Goods and Furniture Plate Linen China Chattels and Effects of what nature kind soever and wheresoever To Hold the same unto the said William Henry Tizard Henry Hayes Tizard and William Legg their Heirs Executors and Administrators upon and to and for the Uses Trusts Ends Intents and Purposes hereinafter named of and concerning the same (that is to say). In Trust that they my said Trustees Do and shall as soon as conveniently may be after my Decease as they in their Discretion may think fit sell and dispose of all or any part of my said freehold and Leasehold Estate Goods Chattels and Effects whatsoever at the best price they may be able to procure for the same and the Money arising thereby to pay and divide in equal Shares and Proportions to and between my three daughters Beata Tizard Sarah Ann Fawconer Tizard and Helen Louisa Fawconer Tizard hereby authorizing and empowering my said Trustees to retain all such reasonable Costs and Charges as they may .e.put(?) unto or be at in the execution of the Trusts aforesaid. It now only remains necessary for use to state my reasons for having disposed of my Estate and Effects in the manner I have which is that having already expended considerable Sums of Money in the Education and placing out in the World of my four Sons I consider that they have already had their fair proportion of my property and that my eldest Daughter Mary by her Marriage is well off in the World and I trust that my sons and Daughters will at all times conduct themselves in brotherly and sisterly Love and Affection towards each other and afford my said three Daughters all the Advice and Assistance in their power. And lastly I do hereby nominate constitute and appoint my said two Sons William Henry Tizard and Henry Hayes Tizard and my said Son in Law William Legg joint Executors of this my Will hereby revoking and making void all former and other Wills by me at any time heretofore made and do declare this to be my last Will and Testament. In witness whereof I the said Henry Hayes Tizard the Testator have to this my Will set my Hand and Seal the day and year first within written.
